I will also complete your means test. This will determine which chapter of bankruptcy you can file under (Chapter 7 vs. Chapter 13). After You File For Bankruptcy

After your bankruptcy case has been filed, you will have a creditor meeting. If you filed a Chapter 7 bankruptcy, the timeline for discharge (the legal court order extinguishing your responsibility on your debt) is approximately 4 months. If you filed a Chapter 13 bankruptcy, the timeline for discharge is 3-5 years. With this in mind, I will recommend either a Chapter 7 or Chapter 13 bankruptcy. This is based largely upon what you qualify for. Also what your ultimate goals are, related to any property that you may intend to keep.
